Terms of Service
These terms are an agreement between you and Spatial AI Labs ("we", "us") covering Spatial Video Studio for iPhone, iPad, Mac and Apple Vision Pro, the cloud conversion service it connects to, and the account you use with them (together, "the Service"). By using the Service you agree to these terms. If you do not agree, do not use the Service.
1. What the Service does
Spatial Video Studio converts ordinary 2D photos and videos into stereoscopic 3D formats, including Apple spatial photos and videos and side-by-side 3D. Conversion runs either on your own device or, if you choose, on our cloud servers. On-device conversion never sends your media anywhere. Cloud conversion uploads the file you choose, converts it on our servers and returns the result to you.
2. Who can use it
You must be at least 13 years old, or older if the law where you live sets a higher minimum for agreeing to terms like these. Using the cloud service or buying anything requires a payment method you are entitled to use.
3. Your account
Most of the app works without an account. Cloud conversion and the feature-request board require you to sign in with your Apple ID through Sign in with Apple. You are responsible for what happens under your account. You can delete your account at any time from the app's Help screen; this removes your projects from the device and deletes your sign-in record. Charges already incurred remain payable.
4. Your content
4.1 You own the photos and videos you bring into the app, and you own the 3D versions the app makes from them. We claim no rights in either. You may use the converted files for any purpose, including commercial work.
4.2 For cloud conversion only, you give us permission to store, copy and process the files you upload, solely to run the conversion and deliver the result to you. This permission ends when the files are deleted from our servers, as described in the Privacy Policy.
4.3 You are responsible for the content you convert. Only upload material you have the right to use, and do not use the Service to process content that is unlawful, that infringes someone else's rights, or that depicts sexual abuse of minors. We may refuse or stop processing, and may close accounts, where we reasonably believe this section has been breached.
4.4 Conversion is automatic. The 3D effect is estimated by machine-learning models from a single image or frame; results vary with the material and may contain artifacts. We do not review your content and do not guarantee any particular outcome.
5. Pro subscription
5.1 Spatial Video Studio Pro is an auto-renewing subscription bought through the App Store. It unlocks exporting and sharing converted files, removes the project limit of the free version, and is required to use cloud conversion. Prices, periods and any free trial are shown in the app before you buy.
5.2 Payment is charged to your Apple ID. The subscription renews automatically at the end of each period unless you cancel at least 24 hours before it ends. You can manage or cancel it in your Apple ID subscription settings; deleting the app does not cancel it. Refunds for App Store purchases are handled by Apple under its terms.
5.3 Pro gives access to cloud conversion but does not include it: cloud usage is billed separately by us, as described in section 6, in addition to the subscription. If your subscription lapses, cloud conversion is unavailable until it is renewed.
6. Cloud conversion and billing
Cloud conversion requires an active Pro subscription. Beyond that it is pay-as-you-go and is billed by us, not through the App Store. The prices in force are shown in the app before you start a conversion and may change over time; a change never affects a conversion you have already started.
6.1 Photos. A daily allowance of cloud photo conversions is free (currently 100 per day, counted in UTC). Beyond that, each photo is priced at the per-photo rate shown in the app and is charged together with your other conversions as described in 6.4. A photo conversion that fails or that you cancel is not charged, but a free slot that was used is not returned.
6.2 Videos. Videos are priced per minute of footage, with a one-minute minimum per video, adjusted for the resolution and options you choose. The app shows an estimate before you start; the final amount is calculated from the actual file.
6.3 Payment method. To convert anything that is not free you need a card on file. We use Stripe to store and charge it; we never see your full card number. Adding a card costs nothing by itself.
6.4 When we charge. Charges are grouped: completed conversions join an open batch on your account and the batch is charged to your card when a few hours have passed, when it reaches your account's cap, or when you choose "Pay Now". The cap starts low for new accounts and rises with your payment history. For unusually large conversions we may place a temporary authorization hold on your card before starting; it is released if the conversion does not run.
6.5 If a charge fails. We will retry and let you know in the app. While an amount is unpaid, new cloud conversions are paused and downloads from the unpaid batch are locked. You can retry the payment or change your card in the app. Once the balance is paid, cloud conversion resumes.
6.6 Cancelling. You can cancel a cloud conversion while it is queued or running. Nothing is charged for a conversion that did not complete. Work that finished before you cancelled is billable.
6.7 Delivery. Results are available to download for 24 hours after a conversion completes. Save what you want to keep: after that the links stop working, and the files are deleted from our storage no later than 90 days after upload. If a conversion fails for a reason on our side, you are not charged for it.
7. Using the Service
Do not misuse the Service: do not try to interfere with it, work around limits or billing, access other people's accounts or data, or reverse engineer the app beyond what the law allows. Do not use automated tools to submit conversions at volumes that degrade the Service for others. The app includes sample media for demonstration; those samples remain our property or that of their licensors and may not be reused outside the app.
8. Feature requests and feedback
The app lets you post and vote on feature requests. Posts are visible to other users and must not contain personal information, offensive material or content you do not have the right to share. We may edit or remove posts. Anything you suggest may be used by us freely, without any obligation to you.
9. Changes to the Service and to these terms
We may change, suspend or discontinue features, prices and the Service itself. When we change these terms in a way that matters, the app will show you the updated version and ask you to accept it before you continue; using the Service after that is acceptance. If you do not accept, stop using the Service and, if you wish, delete your account.
10. Disclaimer
The Service is provided "as is". To the extent the law allows, we make no warranties about its availability, accuracy or fitness for a particular purpose, and we do not guarantee that conversions will succeed or look a certain way. Nothing in these terms removes rights that consumer law gives you and that cannot be excluded.
11. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim arose. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
12. Governing law
These terms are governed by the laws of the United Kingdom. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and disputes may be brought in the courts there.
